These Terms of Use (“Terms”) constitute a legally binding agreement between you (“user,” “you,” or “your”) and Tixie (“Tixie,” “we,” “us,” or “our”) regarding your access to and use of the Tixie: To-do List & Heart Rate mobile application (the “App”) and any related website or services (collectively, the “Service”). By accessing or using the Service, you agree to be bound by these Terms.If you do not agree to these Terms, do not download, install, or use the App.
1. EligibilityYou must be at least 13 years of age to use the App. By using the App, you represent that you are at least 13 years old. If you are under the age of majority in your jurisdiction, you may only use the App under the supervision of a parent or legal guardian who agrees to be bound by these Terms.
2. Health and Wellness DisclaimerThe App is intended solely for general wellness and productivity purposes and is not a substitute for professional medical advice, diagnosis, or treatment. You understand and agree that:• Tixie is not a medical device, and its functionality (e.g., heart rate alerts or wellness tips) is not intended for medical monitoring or intervention.• Any health-related suggestions or alerts provided by the App are generated based on locally stored data and should not be interpreted as medical guidance.• Always seek the advice of a qualified health professional for any questions regarding a medical condition.We disclaim any liability arising from your use of the App for medical decision-making.
3. User ResponsibilitiesYou agree to use the App only for lawful purposes and in accordance with these Terms. You may not:• Use the App in any manner that violates applicable laws or regulations;• Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the App;• Reproduce, redistribute, or exploit the App or any part of the App for commercial purposes;• Attempt to interfere with the proper working of the App or its security measures.
4. PrivacyYour privacy is important to us. The App does not collect or transmit personal or sensitive user data. All app-related data (including heart rate readings, tasks, and preferences) remains stored locally on your device.For information about the limited analytics collected via Apple’s App Store Connect and details regarding website data, please refer to our Privacy Policy.
5. Device Permissions and IntegrationsTo function properly, the App may request access to certain device features or integrations (such as Apple Health/HealthKit) to detect and respond to your pulse. You can control or revoke these permissions in your device settings.We do not store, collect, or transmit any data accessed through these permissions.
6. Push NotificationsIf enabled, the App may send local push notifications for reminders or elevated heart rate alerts. These are generated based on your on-device activity and can be turned off at any time through your device’s notification settings.
7. In-App Purchases & SubscriptionsThe App may offer premium features or content through in-app purchases or subscriptions processed via Apple’s App Store. All billing, renewals, cancellations, and refunds are managed by Apple and subject to Apple’s terms.
8. Intellectual PropertyAll content, software, features, design elements, and trademarks associated with the App are the exclusive property of Tixie or its licensors. These are protected under intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial use in accordance with these Terms.You may not use the App in any way that infringes or misappropriates our intellectual property rights.
9. Feedback & SuggestionsAny ideas, feedback, or suggestions you submit to us may be used to improve the App. By submitting feedback, you grant us a non-exclusive, royalty-free license to use it without obligation or compensation.
10. TerminationWe reserve the right to terminate or suspend your access to the App at any time, with or without notice, if you violate these Terms, engage in unlawful conduct, or misuse the Service.Upon termination, your right to use the App will cease immediately. You may also discontinue use at any time by uninstalling the App.
11. DisclaimersThe Service is provided “as is” and “as available” without warranties of any kind, either express or implied. We do not guarantee that the App will function without interruption, be error-free, or meet your expectations.To the fullest extent permitted by law, we disclaim all warranties, including but not limited to:• Implied warranties of merchantability, fitness for a particular purpose, and non-infringement;• Any warranty regarding the accuracy, reliability, or completeness of any content or data.
12. Limitation of LiabilityTo the maximum extent permitted by law, Tixie, its affiliates, and its service providers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:• Loss of data;• Loss of use;• Health consequences or perceived inaccuracy of health-related notifications;• Damages for loss of profits or goodwill.In no event shall our total liability exceed the amount paid by you (if any) to use the App.
13. Updates and ModificationsWe reserve the right to update or modify these Terms at any time. Updated Terms will be posted within the App or on our website and take effect immediately upon publication unless otherwise specified.Your continued use of the App after changes are made constitutes your acceptance of the updated Terms.
14. Governing Law and Dispute ResolutionThese Terms shall be governed by the laws applicable in the jurisdiction where the App provider is established, without regard to conflict of law provisions. Disputes shall be resolved in the courts of that jurisdiction, unless otherwise required by applicable law.
